These Terms and Conditions are available in German and English. In the event of any discrepancies or contradictions between the language versions, only the German version shall prevail.

Hereinafter referred to as “Transparent Hiring” or the “Company”.
2. Eligibility
Participation in the referral program is only open to existing individual customers of Transparent Hiring.
An existing customer means a natural person who has purchased and fully paid for at least one service from Transparent Hiring before submitting the referral.
Companies, legal entities, agencies, affiliates, professional lead generators, and other business referrers are not eligible to participate in this referral program.
Employees of Transparent Hiring are excluded from participation.
3. Eligible Referred Customers
A referred customer must be a person who was not already known to Transparent Hiring before the referral.
A referral is excluded if the referred customer was already known to Transparent Hiring before the referral, including but not limited to prior contact, existing CRM entries, previous consultations, previous offers, invoices, email correspondence, calls, or other business communication.
4. Referral Process
To be eligible for the referral reward, the referred customer must mention the referring customer during the first contact with Transparent Hiring.
At the latest, the referred customer must mention the referring customer during the first voice call with any representative of Transparent Hiring and, in all cases, before purchasing the relevant service.
5. Successful Referral
A referral is considered successful only if all of the following conditions are met:
- The referred customer was not already known to Transparent Hiring before the referral.
- The referred customer mentions the referring customer in accordance with Section 4.
- The referred customer purchases an eligible service from Transparent Hiring with the gross purchase value of the eligible service is at least EUR 500 and pays the price in full.
- No cancelation, refund, chargeback, payment reversal, or other reversal of the transaction occurs.
- The applicable cancellation, withdrawal, refund, or chargeback period has expired.
The right to receive the referral reward arises only after all conditions listed above have been fully met.
6. Referral Reward
For each successful referral, the referring customer receives one Amazon.de voucher worth EUR 50.
The voucher is issued as a non-cash referral commission for a successful referral.
Cash payment, bank transfer, set-off, exchange, substitution, or conversion of the reward into any other form of compensation is excluded.
The voucher is subject to Amazon’s applicable voucher terms and conditions. Amazon is not the organizer, sponsor, administrator, or partner of this referral program.
7. Cap on Rewards
Each eligible referring customer may receive a maximum of 10 Amazon.de vouchers per calendar year under this referral program.
Once this cap has been reached, no further reward claims arise for additional referrals in the same calendar year, even if those referrals would otherwise meet the requirements of these Terms and Conditions.
8. Issuance of the Reward
The referral reward is issued only after all conditions for a successful referral under Section 5 have been fulfilled.
The reward is usually sent electronically to the email address stored with Transparent Hiring or otherwise provided by the referring customer.
Transparent Hiring is not responsible for failed delivery if the referring customer provides an incorrect email address.
9. Taxes
The recipient of the referral reward is solely responsible for the proper tax treatment of the reward.
Transparent Hiring does not apply flat-rate taxation under Section 37b of the German Income Tax Act.
Transparent Hiring treats the reward as consideration for a successful referral. This does not affect the recipient’s own tax obligations.
Participants should consult a tax advisor if they are unsure about the tax treatment of the reward.
10. Abuse and Exclusion
Transparent Hiring may exclude participants from the referral program and refuse to issue a reward if there are indications of abuse, manipulation, sham transactions, false information, multiple registrations, circumvention, or other violations of these Terms and Conditions.
11. Communication and Advertising by Participants
Participants may use the referral program only in a lawful manner.
Participants are solely responsible for ensuring that their referral communication does not constitute unlawful advertising, harassment, spam, or a violation of applicable law.
In particular, participants must not send unsolicited advertising emails, spam, or other unlawful direct marketing communications.
Transparent Hiring is not liable for unlawful conduct by participants in connection with their referral activities.
12. Data Protection
Transparent Hiring processes personal data in connection with the referral program only to the extent necessary to operate, verify, and administer the referral program.
This may include, in particular:
- Name and contact details of the referring customer.
- Customer data required to verify eligibility.
- Name and contact details of the referred customer.
- Information required to attribute the referral.
- Information regarding the purchase, payment status, and expiry of any cancellation, withdrawal, refund, or chargeback period.
- Information regarding the issuance of the reward.
- Accounting and tax-relevant records.

13. Modification or Termination of the Referral Program
Transparent Hiring reserves the right to modify, suspend, or terminate the referral program at any time with effect for the future.
Referrals validly submitted before such modification, suspension, or termination will continue to be considered under these Terms and Conditions, provided that all requirements for a successful referral are fulfilled.
There is no entitlement to the continuation of the referral program.
14. Liability
Transparent Hiring is fully liable for intent, gross negligence, and injury to life, body, or health.
In cases of simple negligence, Transparent Hiring is liable only for the breach of essential contractual obligations. In such cases, liability is limited to the foreseeable and typical damage.
Any further liability is excluded to the extent permitted by law.
Transparent Hiring is not liable for the redemption, availability, usability, or terms of Amazon.de vouchers where these are governed by Amazon.
15. Governing Law
These Terms and Conditions are governed by the laws of the Federal Republic of Germany.
Mandatory consumer protection provisions remain unaffected.
16. Final Provisions
If any provision of these Terms and Conditions is or becomes invalid in whole or in part, the validity of the remaining provisions remains unaffected.
The statutory provisions shall apply in place of the invalid provision.
